Municipal Court Domestic Violence Protocol for Termination of a Temporary Protection or No Contact Order
1. The court sets a standard of at least six
contacts between the offender and the Domestic Violence Offender
Intervention Program (Person to Person Resources, Inc. or Family Service
Counseling Center of Wood County) before the lifting of a Temporary
Protection Order (TPO) or No Contact Order will be considered. 2. After at least six contacts, it is the responsibility of the offender to write a letter to the program facilitator listing the reasons why he/she thinks the order should be lifted, and to review the letter individually with a program facilitator. The offender program facilitator would then make a recommendation to the judge based on the offender’s letter and the progress of the offender in the group. It is understood that the lifting of the TPO/No Contact Order is a privilege that is to be earned back by the offender. Should the facilitator not recommend the lifting of the order, a future date would be set to reconsider the issue. The final decision resides ultimately with the judge.
3. Nothing in this protocol should be understood to suggest that there is ever an automatic lifting of a TPO/No Contact Order.
4. This protocol is predicated upon the fact that the victim desires to have the TPO/No Contact Order lifted.
